CJC 232 Civil Liability

This course covers liability issues for the criminal justice professional. Topics include civil rights violations, tort liability, employment issues, and other related topics. Upon completion, students should be able to explain civil trial procedures and discuss contemporary liability issues.

Course is typically offered in Spring.
Student Learning Outcomes (SLOs)
At completion of the course, the student should be able to do the following:

  1. Explain the difference between criminal law and civil law.
  2. Compare state civil lawsuits and federal civil lawsuits.
  3. Apply the requirements of 42 U.S.C. Section 1983 to given scenarios to determine if a civil rights violation has taken place.
  4. Analyze situations involving intentional (tortuous) and unintentional (negligent) acts that may create potential liability for criminal justice employees and agencies.
  5. Examine various bars and defenses to civil liability.
  6. Analyze the impact of legal decisions on issues confronting law enforcement administrators and managers.
  7. Identify proactive steps that can be taken to minimize the liability risks to practitioners and their employing agencies.
