LEX 260 Bankruptcy and Collections Lecture: 3 Lab: 0 Clinic: 0 Credits: 3 This course provides an overview of the laws of bankruptcy and the rights of creditors and debtors. Topics include bankruptcy procedures and estate management, attachment, claim and delivery, repossession, foreclosure, collection, garnishment, and post-judgment collection procedure. Upon completion, students should be able to prepare and file bankruptcy forms, collection letters, statutory liens, and collection of judgments.
Pre-requisite(s): LEX 120. Course is typically offered in Spring. Student Learning Outcomes (SLOs) At completion of the course, the student should be able to do the following:
- Demonstrate the application of relevant provisions of the United States Bankruptcy Code by submission of briefs of courtopinions.
- Define the legal procedure related to debt collection in North Carolina from the legal position of the debtor by in-class role play and through written examination. Define the legal procedure related to debt collection in North Carolina from the legal position of the creditor by in-class role play and through written examination.
- Demonstrate the application of the U.S. Code relating to various Bankruptcy Petitions through written examination.
- Compose a complete Chapter 7 Bankruptcy Petition to be filed with the United States District Court for the Middle District of North Carolina when given a fact pattern.
- Compose a collection letter using information provided in a set of facts.
